Bighouse Estate Terms and Conditions
In these Terms and Conditions, references to the "Estate" and to "we" or "us" means the Bighouse Lodge and surrounding grounds operated by Bighouse Estate Partnership of Melvich, Sutherland, and "you" and "your" means the person, firm or company making a booking or staying or taking part in sporting activities at the Estate.
These Terms and Conditions form part of a binding contract between you and the Bighouse Estate Partnership. By signing the booking form you agree to these Terms and Conditions. No contract shall be formed between us until such time as we issue a confirmation letter to you.
Booking Arrangements
Upon receiving an inquiry from you we will contact you to discuss your specific requirements. A booking form will then be issued to you specifying the details of your package as discussed with us which should be completed, signed and returned to us. Upon receipt of the signed booking form we shall confirm availability and thereafter issue a confirmation letter to you.
No contract shall be formed between you and us until such time as we issue a confirmation letter to you.
Payment
Where the booking for facilities offered by the Estate is made by you and confirmed by us (the "Booking") more than eight weeks before the date on which the Booking is to begin we will send you an invoice for a non-refundable deposit of 25% of the total price of the Booking. This invoice will be sent to you along with the confirmation letter. This must be paid by you within 14 days of receipt. If this is not paid by the due date, we will treat the Booking as cancelled and we will be entitled to re-let any or all of our facilities forming part of the Booking without further notice to you.
An invoice for the balance will be sent to you eight weeks prior to the date on which the Booking is to begin and must be paid by you within 30 days of receipt. If this is not paid by the due date, we will treat the Booking as cancelled and we will be entitled to re-let any or all of our facilities forming part of the Booking without further notice to you.
Where the Booking is made less than eight weeks before the date on which the Booking is to begin , then the total amount will be payable upon confirmation of the Booking and we will send you an invoice for the total price of the Booking when we send the confirmation letter to you. If this is not paid [within seven days] of your receipt of the confirmation letter, we will treat the Booking as cancelled and we will be entitled to re-let any or all of our facilities forming part of the Booking without further notice to you.
All cheques should be made payable to the Bighouse Estate.
Prices
The price for the Booking will be as detailed in the booking form and will reflect your specific needs.
Insurance
The Estate has organised third party liability insurance up to the level of £10 million but the cover is conditional upon you, in the case of shooting, having at least two years experience or being accompanied at all times by a member of the party who has at least two years experience of shooting themselves. You must comply with these conditions at all times.
You must take out holiday insurance against you having to cancel your holiday.
Cancellation
We may cancel a booking at any time up to the day falling 10 days before the scheduled date of arrival by sending writing notice of the cancellation to you. In these circumstances we will refund to you any sums paid by you. The Estate will not pay any costs or reimburse losses you suffer because of the cancellation
The Estate will also be entitled to cancel a booking or any/all activities if factors which can reasonably be considered to be outside the Estate's control make it unlikely the Estate will be able to comply with its obligations (examples are when it is inadvisable to use, or restrictions have been imposed on travel to or through, the Estate because of disease or unrest, or because of political or industrial relations activity). Where applicable the Estate will try to offer to you suitable alternative dates later in the season or if it is not possible then the Estate will refund to you any sums paid by you. In either case the Estate will not pay any costs or reimburse losses you suffer because of the cancellation.
You may cancel the Booking at any time up to 5pm on the day falling 4 weeks before the scheduled date on which the Booking is to begin. In these circumstances you will be entitled to a refund of all sums paid by you less 25% of the total price of the Booking which is the non-refundable deposit.
If you cancel your Booking at any time after the time set out in Clause 5.2 you will not be entitled to a refund of sums paid by you unless the Booking can be re-let in which case you will receive a refund of all sums paid by you less 25% of the total price of the Booking which represents an administration charge.
Liability
We will only be liable for reasonably foreseeable loss or damage to you or your property caused by any wilful act, negligence or fault of us or our employees and/or for any death or personal injury caused by a breach of duty by us or our employees. In the absence of such negligence or breach of duty you take part in sporting activities at your own risk.
The Estate does not offer secure facilities for any valuables so please do not bring these with you and we will not be liable for any loss or damage to your possessions which are left in vehicles on the Estate.
You will be liable to the Estate for any damage caused to the Estate's property where such damage is reasonably foreseeable or is caused by the wilful act, negligence or fault of you, any member of your party or your or their guests, excluding any damage caused by normal wear and tear.
Neither the Estate nor you will be liable to the other for any failure to perform any obligations specified in these Terms and Conditions (other than an obligation to pay money) where such failure arises due to circumstances outwith the reasonable control of that party.
IMPORTANT - Legal requirements
You and all members of your party who take part in any shooting activity must have a current UK shotgun certificate or overseas visitors shotgun permit or a firearms certificate if appropriate and also a current game licence. These should be produced to the Estate on the morning of the day's sport.
IMPORTANT - Safety
You and each member of your party must ensure that you are fit to take part in sporting activities and that your firearm is fit for the purpose. The Estate is not qualified to determine whether this is the case.
You must not participate in any sporting activity if you are suffering from any serious medical condition or have recently undergone surgery or are under the influence of alcohol or drugs.
You and all members of your party must take part in the safety briefings given on the first day of the sporting activity and promptly comply with all instructions given by the Estate Manager whether in the sporting briefing or later. Failure to comply with such instructions may result in cancellation of the remainder of the Booking and you will have no right to a refund or compensation.
The Estate may refuse to permit you or any member of your party to participate in the sporting activity whose conduct is dangerous or irresponsible, and you will have no right to a refund or compensation.
Law
These Terms and Conditions shall be governed by Scots Law.
Data Protection
The Estate will provide your details and those of the members of your party to the organisers of your sporting activities. The Estate will not pass these details on to third parties unless this is necessary to arrange your activities but this may involve a credit reference check. The Estate may use the details to notify you of events if they think these could be of interest to you. Complaints
If you are unhappy with any aspect of your package please notify the Estate in writing within 7 days of your departure.
